0. Definitions
For the purposes of these Terms and Conditions, the following definitions apply:

“Client” refers to the individual or entity making a booking or on whose behalf a booking is made with JourneyTo, and who is bound by these Terms and Conditions.

“JourneyTo” refers to the travel service provider facilitating the planning, coordination, and arrangement of travel experiences, accommodations, and related services as outlined in the client’s booking.

“Third-party supplier” refers to any external provider of services booked through JourneyTo, including but not limited to lodges, hotels, flight booking agents, transportation companies, activity providers, and insurance companies. These suppliers operate independently and are subject to their own terms and conditions.

“Force Majeure” refers to any unforeseeable and unavoidable event or circumstance beyond the control of JourneyTo or the client, which prevents the performance of contractual obligations. This includes but is not limited to natural disasters, war, strikes, civil unrest, epidemics, government restrictions, and other major disruptions.

1. Booking and Payment

1.1. Booking Confirmation:
All bookings are subject to availability and confirmation by JourneyTo. A booking is considered confirmed when JourneyTo issues a written confirmation or invoice.

1.2. Payment:
The client is required to make payments in accordance with the payment schedule specified in the booking confirmation. Payments must be made in the currency stated on the invoice and through the specified payment methods.

1.3. Payment Surcharges:
Payments made by certain methods, such as credit cards or international bank transfers, may be subject to additional surcharges. Clients are responsible for covering any associated fees.

1.4. Payment schedules:
Payment schedules will be clearly outlined in the booking confirmation. Clients are required to adhere to the specified payment deadlines. Failure to meet payment deadlines may result in booking cancellation.

1.5. Currency and Exchange Rates:
All payments must be made in the currency stated on the invoice. Currency exchange rates, if applicable, will be determined by JourneyTo and clearly communicated to the client at the time of payment. Any fluctuations in exchange rates after payment will not affect the agreed-upon price.

1.6. Deposit and Final Payment:
A non-refundable deposit, as specified in the booking confirmation, is required to secure the booking. This deposit will be deducted from the total booking cost. The final payment is due as per the payment schedule outlined in the booking confirmation.

1.7. Late Payments and Booking Cancellation:
Clients are responsible for ensuring that payments are made on time and in full. Failure to make payments by the specified due dates may result in the cancellation of the booking. Cancellation fees, as outlined in the terms and conditions, may apply.

1.8. International Transfers and USD Payments:
For any payments made in USD, clients are required to transfer funds into our designated USD account. Please ensure that the transfer is made using the ‘OUR’ instruction (covering all charges), which guarantees that you, the sender, are responsible for all international bank and intermediary fees. This ensures that the full invoiced amount is received without deductions.
If the full balance is not received due to bank fees or deductions, we may follow up to recover the shortfall before confirming the booking.

1.9. Credit Card Payments:
JourneyTo offers credit card payment links for your convenience. However, a 5% processing fee will be added to your invoice total to cover associated credit card charges. This applies to both local and international credit card payments, including those made to our USD account.

1.10. Flight Payments:
JourneyTo works with a trusted third-party flight supplier who books flights on behalf of our clients. A handling fee may apply, charged by the supplier for arranging and securing flight bookings.
To proceed with a flight booking, clients must provide the full names of all passengers (as per passport) and their dates of birth. Flight availability and pricing are subject to change, and as such, we require full payment at the time of booking in order to secure the tickets.
Once client details are received, our flight supplier will hold the selected tickets, and a separate credit card payment link will be issued to complete the booking.
It is the client’s responsibility to carefully review and confirm all flight details, including passenger information, dates, and times. JourneyTo will not be held liable for errors or discrepancies once the client has approved the booking.

1.11. Payment Terms – Accommodation, Transfers & Flights Rates:
All accommodation, transfer, and flight costs are quoted in either USD or ZAR, as specified in your quotation.
Currency: For properties and services within South Africa, we accept payment in ZAR. For international properties and services, payment will be required in USD (unless otherwise stated in your quotation).
Payment Method: Payments can be made via bank transfer (wire) or credit card. A 5% surcharge applies to all invoices settled via credit card. We currently accept Visa and Mastercard only.
Responsibility for Bank Charges: When making international payments, clients must select OUR (all charges for applicant’s account) to ensure full invoiced amounts are received.

2. Cancellation and Refunds

2.1. Cancellation:
Cancellations of confirmed bookings may only be made in writing and are subject to the terms and conditions outlined in the cancellation policy provided in the booking confirmation.

2.2. Cancellation Fees:
Clients shall be responsible for any cancellation fees as specified in the cancellation policy. These fees are calculated based on the total booking cost and the notice period provided for the cancellation.

2.3. No-shows:
Clients who fail to arrive or do not show up for a booking without prior notice may forfeit their right to a refund.

2.4. Refunds:
Approved refunds will be processed within 30 business days unless otherwise specified in the client’s booking confirmation.

3. Travel Documents and Health

3.1. Travel Documents:
It is the client's responsibility to ensure that all required travel documents, including passports, visas, permits, and vaccinations, are obtained and valid for the entire duration of the trip.

3.2. Health Precautions:
Clients should take all necessary health precautions, including vaccinations and medications, as advised by their healthcare provider or travel clinic. JourneyTo is not responsible for clients being refused entry to any country due to incomplete health documentation or vaccinations.

4. Travel Insurance

4.1. Travel Insurance Recommendation:
JourneyTo strongly recommends that clients purchase comprehensive travel insurance covering various aspects such as medical care, pre-existing medical conditions, emergency assistance, accidental disability and death, force majeure events, theft and loss, cancellations and curtailments, personal liability, and more.

4.2. Insurance Responsibility:
Clients are solely responsible for obtaining appropriate travel insurance. JourneyTo may provide information regarding available insurance options, but the selection and purchase of insurance are the client's responsibility.

5. Force Majeure

JourneyTo shall not be held liable for any delays, disruptions, or cancellations caused by force majeure events, including but not limited to war, strike, civil strife, riot, industrial dispute, natural or nuclear disaster, fire, adverse weather conditions, governmental interference, or any other external circumstances beyond JourneyTo's control.

6. Traveler Responsibilities

6.1. Compliance with Laws:
Clients are responsible for adhering to all local laws, regulations, and customs of the countries they visit during their journey. Any violations or illegal behaviour may result in termination of services without refund.

6.2. Accuracy of Booking Details:
Clients are responsible for ensuring that all travel dates and booking details, including flight dates, accommodation details, and itinerary specifics, are accurate at the time of booking. JourneyTo shall not be held responsible for discrepancies or errors in travel dates or booking details once the booking is confirmed.

6.3. Children/Minors:
Minors must be accompanied by a responsible adult. The adult assumes full responsibility for the minor's participation and safety.

7. Third-Party Suppliers and Their Terms and Conditions

7.1. Supplier Relationships:
JourneyTo collaborates with various third-party suppliers, such as transfer companies, lodges, hotels, and flight booking agents, to provide comprehensive travel services.

7.2. Supplier Terms:
Each third-party supplier may have its own terms and conditions governing aspects of your booking, such as transfers, accommodations, or flights.

7.3. Applicability:
Clients are advised that the terms and conditions of these third-party suppliers will be applicable to their bookings and arrangements. JourneyTo will provide clients with access to these terms and conditions upon request.

7.4. Responsibility:
It is the responsibility of clients to review and understand the terms and conditions of the specific third-party suppliers relevant to their booking. JourneyTo will facilitate the provision of these terms upon request but does not assume responsibility for the content or enforcement of third-party terms and conditions.

8. Amendments and Changes

8.1. JourneyTo’s Right to Amend:
JourneyTo reserves the right to amend itineraries, accommodations, transportation, or other aspects of the trip as necessary due to unforeseen circumstances or changes beyond our control. Any additional costs incurred as a result of such changes may be passed on to the client.

8.2. Client-Requested Changes:
Should the client request any changes to a confirmed booking (e.g., dates, participants, services), JourneyTo will make reasonable efforts to accommodate such changes, subject to availability and any applicable fees.

9. Dispute Resolution

9.1. Resolution Methods:
Any disputes arising from these terms and conditions or related to JourneyTo's services shall be resolved through negotiation, mediation, or arbitration, as determined by JourneyTo.

9.2. Limitation of Liability:
To the maximum extent permitted by law, JourneyTo shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue, profits, or enjoyment, arising from or related to the use of our services.

9.3. Governing Law:
These terms and conditions shall be governed by and interpreted in accordance with the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of South African courts.

10. Data Privacy

JourneyTo collects and processes personal data in accordance with applicable data protection laws. For further details, please refer to our Privacy Policy.

11. Applicability and Amendments

11.1. Applicability:
These terms and conditions are applicable to all clients of JourneyTo and are subject to change without notice. The most recent version of the terms and conditions will be made available on our website.

11.2. Communication:
All notices, requests, or communications to JourneyTo must be made in writing and sent to the contact details provided in the booking confirmation or on our website.

12. COVID-19

By choosing to travel, you acknowledge that it is your personal decision, and you are fully informed about the current travel recommendations and restrictions related to COVID-19. You assume full personal responsibility for staying informed about these matters. JourneyTo is not responsible for any unsafe conditions or health hazards, including pandemics or illnesses, to which you may be exposed during your travels.

JourneyTo will make reasonable efforts to provide you with the latest travel information regarding COVID-19 regulations, conditions, and supplier terms at the time of your booking. However, please note that this information is obtained from third-party sources and may change without notice. Therefore, JourneyTo, its employees, and agents will not be liable for any loss (financial or otherwise), damage, illness, harm, trauma, death, delay, denial of onward travel, or costs (including quarantine costs) that you may incur, whether during or after your travel, related to the risks and dangers associated with traveling during the COVID-19 pandemic. This applies whether or not JourneyTo informed you of these risks and dangers at the time of booking.

JourneyTo is not responsible for the acts or omissions of travel suppliers, including their failure to adhere to schedules, provide services, issue refunds, or honor future trip credits.

Please note that many insurance policies specifically exclude coverage for epidemics and pandemics, especially when travel warnings are in place. If you have any questions about the appropriateness of your travel insurance policy, we recommend consulting an insurance broker. JourneyTo is not liable for your decision not to purchase insurance, nor for any denial of claims by a travel insurer related to COVID-19 or any other claim under the policy.

13. Acceptance of Terms and Conditions

Upon receipt of the final invoice or quote from JourneyTo, and upon the client's approval of the quote or invoice by payment or written confirmation, it is understood and agreed that the client has accepted JourneyTo's terms and conditions as outlined above.
